Illinois Statutes of Limitations

The applicable statute of limitations depends on the nature and cause of the accident, along with other factors. In Illinois, the following statutes of limitations apply:

  • Personal Injury: generally two years from the date of the accident
  • Slip and Fall Accidents/Premises Liability: generally two years from the date of the accident if the accident occurred on private property, or within one year of the date of the accident if the accident occurred on public property
  • Medical Malpractice: generally two years from the date of the act giving rise to the injury, or four years if the injury cannot reasonably be discovered during two years
  • Wrongful Death: generally two years from the date of death
  • Product liability: generally two years from the date of injury
  • Workers’ Compensation: two years from the last payment of compensation from your employer’s insurance company or three years from the date of your injury, whichever is later
