Workers’ Compensation Benefits

Workers’ compensation benefits are generally available to injured workers, regardless of who was at fault for the accident. The amount of a workers’ compensation settlement depends on the extent of the injuries and the injured worker’s wages. There are legal limits on the amount of workers’ compensation benefits that an injured worker can receive, as well.
Depending on the extent of the work-related injury, the Illinois Workers’ Compensation Act provides for the following worker’s compensation benefits:

  • Medical expenses
  • Temporary total disability (TTD) benefits equal to two-thirds of your average gross weekly wage, up to a weekly maximum payment amount, if you are unable to work while recovering
  • Permanent total disability (PTD)or permanent partial disability (PPD) benefits based on a percentage of your pre-injury wage, up to a weekly maximum payment amount
  • Vocational rehabilitation benefits

Personal Injury Damages

Workers’ compensation laws prohibit an injured worker from suing his or her employer following a workplace accident, but depending on the circumstances of the workplace accident, the injured worker may be able to obtain personal injury damages in a third-party cause of action.
Third-party actions can apply to a number of situations, but they commonly arise in the following accidents:

  • Motor Vehicle Accidents – Delivery drivers and truckers may be injured in a motor vehicle accident while on the job. If the accident was caused by a negligent motorist, he or she could be held liable.
  • Medical Malpractice – If a workplace accident is exacerbated by medical malpractice, the responsible doctor or hospital could be liable in a medical malpractice lawsuit.
  • Slip and Fall Accident – If a worker is injured on the property of another person while on the job, the property owner or manager could be liable for the failure to maintain a safe property.
  • Dangerous and Defective Equipment – Workplace accidents caused by defective equipment or machinery may result in liability against the product manufacturer.
  • Construction Worker Accidents – General contractors are responsible for maintaining a safe construction site and could be held liable for any construction accident injuries. Moreover, construction equipment manufacturers can be held liable if a construction accident is caused by a dangerous or defective product that they made.

Whereas workers’ compensation benefits are subject to certain legal limits and are based on the injured worker’s wages, damages in a third-party personal injury cause of action may include compensation for medical bills, lost income, pain and suffering, and disfigurement. Third-party claims may also include punitive damages, as well.
